I was hoping it would be Rehnquist, of course. Or, as a long shot, Scalia or Thomas. Because you could hardly do worse than those three, no matter whom you nominated to the Supreme Court. Since it was
Sandra Day O’Connor who announced today that she would retire, it throws everything up in the air. She's really a conservative, but she has been a moderating influence because she sees both sides of issues and usually comes down on the side that makes the most (constitutional) sense to her. She isn’t a hard line ideologue like her colleagues to the right. Still, the best that can be said of this development is that justices often surprise the president who appointed them. Earl Warren was supposed to be a conservative, and look at all the good he did over the years. It could be a lot worse. It could be Breyer or Ginsberg or Souter.
